Over the past decade, the Czech Republic has taken a very tolerant stance towards cannabis, shaping how the plant is viewed both legally and culturally across the country.

On January 1st, 2010, the Czech Republic decriminalized the possession of up to 15 grams of cannabis flower and the cultivation of up to five plants for personal use.

However, in August 2013, the Supreme Court changed this threshold, lowering the maximum limit to 10 grams, meaning that if someone possesses less than 10 grams of cannabis for personal use, it will not lead to an arrest or conviction but may lead to a fine of up to 15,000 CZK. 

This decriminalization law also applies to the cultivation of no more than five weed plants for personal use. 

Medical marijuana has also been legal in the Czech Republic since 2013, allowing patients with specific health conditions to get access to the plant for treatments and allowing patients with a licence to cultivate their own cannabis plants.

No, weed is not legal in the Czech Republic. Only medical cannabis is legal for patients with specific health conditions.  

How Much Medical Weed Can Someone Possess in the Czech Republic?  

A patient can have up to 180 grams of medical cannabis per month.  

Is Weed Decriminalized in the Czech Republic?  

Yes, possession of up to 10 grams of cannabis for personal use is decriminalized and can result in a fine of up to 15,000 CZK.

The cultivation of five marijuana plants in the home is also decriminalized and can result in a fine of up to 15,000 CZK. 

What Does Decriminalized Mean?  

Cannabis decriminalization means the plant remains technically illegal, but possession is no longer treated as a criminal offense. Instead of arrest or imprisonment, people found with amounts below the decriminalized threshold will receive a warning, fine, referral to a drug treatment program, or another non-criminal penalty.  

By removing criminal penalties, decriminalization helps reduce the social and economic impact of enforcing cannabis laws, such as policing, court proceedings, and jail time.  

Can You Grow Your Own Plants in the Czech Republic?  

Cultivating your own plants is illegal, but growing up to five plants is decriminalized. Instead of an arrest or conviction, the person may receive a fine of up to 15,000 CZK if they are found with no more than five weed plants.

Medical marijuana patients can legally grow cannabis in the Czech Republic if they obtain a license.  

Is CBD Legal in the Czech Republic? 

Yes, hemp-derived CBD containing less than 0.3% THC is legal in the Czech Republic.
